Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Beacon web application, Beacon Browser application, and all related services provided by Beacon Digital, LLC ("we," "us," or "our"), collectively referred to as the "Service." By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

2. Definitions

  • "User," "you," and "your" refer to the individual accessing or using the Service. Users must be parents or legal guardians of the children whose activity is monitored.
  • "Child" refers to a minor whose viewing activity on YouTube, YouTube Kids, and TikTok is monitored through the Service, as designated by the User.
  • "Subscription" refers to the purchased right to access and use paid features of the Service according to the selected plan.
  • "Watch Data" refers to video titles, channel names, watch duration, timestamps, and related metadata collected from YouTube, YouTube Kids, and TikTok through the Service.
  • "Content" refers to AI-generated summaries, theme analyses, concern flags, digest reports, and channel profiles produced by the Service.
  • "Intellectual Property Rights" means all patent rights, copyright rights, moral rights, trademark rights, trade secret rights, and other intellectual property rights as may exist now or hereafter come into existence.

3. Acceptance of Terms

By creating a Beacon account, installing Beacon Browser, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

4. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting a prominent notice on the Service or by sending you an email at least 30 days before the changes take effect. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service before the changes take effect.

5. Eligibility

To use the Service, you must be at least 18 years old or the age of legal majority in your jurisdiction, whichever is greater. By using the Service, you represent and warrant that you meet this eligibility requirement.

6. Service Description

Beacon is a parental awareness tool that helps parents understand what their children watch on YouTube, YouTube Kids, and TikTok. The Service uses AI to generate summaries, identify themes, and flag content that may need parental attention. The Service does not block, filter, or restrict content. It provides information to help parents understand their child's viewing activity.

The Service consists of:

  • A web application at joinbeacon.io where parents create accounts, manage child profiles, view digests, and access content analysis
  • Beacon Browser (iOS + Android): a browser application installed on the child's device that captures YouTube, YouTube Kids, and TikTok watch activity and transmits Watch Data to the parent's account

7. Accounts

You must create an account to access the Service. You are responsible for:

  • Providing accurate, current, and complete information during registration
  • Maintaining the confidentiality of your password and account credentials
  • All activities that occur under your account, including activity on paired child devices
  • Notifying us immediately of any unauthorized use of your account at [email protected]

We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms.

8. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically:

  • You must have legal authority (as a parent or legal guardian) over any child whose device you monitor using Beacon.
  • You may not use Beacon to monitor adults or anyone over whom you do not have legal parental or guardian authority.
  • You may not use the Service for any illegal or unauthorized purpose.
  • You may not attempt to breach any security or authentication measures.
  • You may not interfere with or disrupt the Service or servers connected to the Service.
  • You may not use automated scripts, bots, or other means to collect information from the Service.
  • You may not exceed the usage limitations associated with your Subscription plan.
  • You may not reverse engineer, decompile, or disassemble any part of the Service.

9. Beacon Browser

By installing Beacon Browser on a child's device, you represent and warrant that:

  • You are the parent or legal guardian of the child who uses the device.
  • You have the legal authority to install monitoring software on the device.
  • You are responsible for any disclosure to the child that may be required by your local laws.

Beacon Browser captures watch activity on YouTube, YouTube Kids, and TikTok only. It does not access other apps, messages, photos, location, or any other device data. The app does not use Accessibility Service, Device Admin, or Notification Access permissions.

10. Subscription Terms

10.1 Plans and Billing

The Service offers free and paid Subscription plans. The features and pricing of each plan are described on our pricing page. By subscribing to a paid plan, you authorize us to charge the applicable Subscription fee to your designated payment method at the beginning of each billing period.

10.2 Automatic Renewal

All paid Subscriptions automatically renew at the end of each billing period (monthly or annually, depending on your plan) unless you cancel before the renewal date. By subscribing, you authorize us to automatically charge your payment method at the then-current rate upon renewal.

10.3 Price Changes

We may change the price of Subscription plans from time to time. We will provide notice of any price changes at least 30 days before the change takes effect. Your continued use of the Service after a price change constitutes your agreement to pay the updated price. If you do not agree, you must cancel your Subscription before the change takes effect.

10.4 Cancellation

You may cancel your Subscription at any time through your account settings. Upon cancellation, your Subscription will remain active until the end of your current billing period. You will not receive a refund for any portion of the Subscription fee already paid, except as required by applicable law.

10.5 Refunds

All Subscription fees are non-refundable except as expressly stated in these Terms or as required by applicable law.

11. Free Trials

We may offer free trials of paid features. Free trial eligibility is determined at our discretion. Unless otherwise stated, your account will revert to the free plan at the end of the trial period. We reserve the right to modify or terminate free trial offers at any time without notice.

12. Content Summaries and AI-Generated Content

The Service uses artificial intelligence to generate content summaries, theme analyses, concern flags, and other content. You acknowledge and agree that:

  • AI-generated content may contain errors, inaccuracies, or omissions.
  • AI-generated content is not professional advice of any kind — including but not limited to medical, psychological, educational, or legal advice.
  • You are solely responsible for any decisions or actions you take based on content provided by the Service.
  • We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.

13. Intellectual Property

13.1 Our Intellectual Property

The Service and its original content (excluding Watch Data provided by you), features, and functionality are and will remain the exclusive property of Beacon Digital, LLC and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws of the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Beacon Digital, LLC.

13.2 Your License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial parental monitoring purposes. This license does not include the right to:

  • Modify, copy, or create derivative works based on the Service
  • Resell, sublicense, or distribute the Service or any content therein
  • Use the Service for any commercial purpose
  • Remove or alter any copyright, trademark, or other proprietary notices

13.3 Your Data

You retain all ownership rights to your Watch Data and account information. By providing data to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, store, and process your data solely as necessary to provide the Service to you.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

BEACON DIGITAL, LLC DOES NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
  • THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE
  • ANY ERRORS IN THE SERVICE WILL BE CORRECTED
  • THE SERVICE WILL DETECT, FLAG, OR IDENTIFY ALL CONTENT THAT MAY BE CONCERNING OR INAPPROPRIATE
  • AI-GENERATED SUMMARIES, ANALYSES, OR CONTENT FLAGS WILL BE ACCURATE OR COMPLETE

YOU ACKNOWLEDGE THAT BEACON IS A SUPPLEMENTARY PARENTAL AWARENESS TOOL AND IS NOT A SUBSTITUTE FOR DIRECT PARENTAL SUPERVISION. THE FAILURE OF THE SERVICE TO FLAG OR IDENTIFY SPECIFIC CONTENT DOES NOT MEAN THAT CONTENT IS APPROPRIATE FOR YOUR CHILD.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BEACON DIGITAL, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
  • ANY CONTENT OBTAINED FROM THE SERVICE, INCLUDING AI-GENERATED SUMMARIES AND ANALYSES
  • THE FAILURE OF THE SERVICE TO DETECT, FLAG, OR ACCURATELY CHARACTERIZE ANY CONTENT
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF BEACON DIGITAL, LLC FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.

16. Indemnification

You agree to indemnify, defend, and hold harmless Beacon Digital, LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person, including the rights of any child you monitor using the Service
  • Any claim that your use of the Service violated applicable law, including laws regarding monitoring or surveillance

Beacon Digital, LLC reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Beacon Digital, LLC in asserting any available defenses.

17. Dispute Resolution and Arbitration

17.1 Informal Resolution

Before filing a formal claim against us, you agree to attempt to resolve the dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute by contacting you via email. If the dispute is not resolved within thirty (30) days after submission, you or we may initiate formal proceedings as described below.

17.2 Binding Arbitration

You and Beacon Digital, LLC agree to resolve any disputes arising out of or relating to these Terms or the Service through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. You acknowledge and agree that you are waiving the right to a trial by jury and the right to participate in a class action.

17.3 Class Action Waiver

YOU AND BEACON DIGITAL, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

17.4 Exceptions

This arbitration agreement does not apply to: (1) disputes that qualify for small claims court; (2) disputes related to intellectual property rights (patents, trademarks, copyrights, or trade secrets); or (3) any claim for injunctive relief.

17.5 Opt-Out

You have the right to opt out of this arbitration agreement within thirty (30) days of first agreeing to these Terms by sending written notice to [email protected] stating your decision to opt out. If you opt out, all other provisions of these Terms will continue to apply.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

19. Service Availability

We will make reasonable efforts to keep the Service operational, but we do not guarantee continuous, uninterrupted, or error-free access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

20. Termination

20.1 By You

You may delete your account at any time from the Settings page of the Service. When your account is deleted, all associated data — including child profiles, watch history, digests, monthly profiles, parent feedback, and authentication tokens — is permanently removed from our database. AI-generated content cache (per-video summaries and channel profiles) is retained because it contains no identifier of you or your child; see the Privacy Policy, Section 8.

20.2 By Us

We reserve the right to suspend or terminate your access to the Service at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination by us:

  • Your license to use the Service will immediately cease
  • We may, at our discretion, delete your data or retain it for a reasonable period to allow you to retrieve it

21. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Beacon Digital, LLC regarding your use of the Service and supersede any prior agreements.

23. Assignment

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you without the prior written consent of Beacon Digital, LLC. Beacon Digital, LLC may assign these Terms without restriction.

24. Waiver

The failure of Beacon Digital, LLC to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

25. Force Majeure

Beacon Digital, LLC shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, pandemics, government actions, or failures of third-party services.
